2017 RESOLVE State Legislative Efforts

RESOLVE works with advocacy volunteers and other organizations to ensure equal access to all family building options for men and women experiencing infertility or other reproductive disorders. In 2017, RESOLVE will be tracking bills that impact the infertility community, whether they are pro-family or anti-family bills. Find out what is happening in your state.  State: Arkansas Resolution Number: SJR 9 Resolution Name: “An application to Congress to call a Convention for proposing an amendment under the United State Constitution, Article V, for the purpose of proposing an amendment providing that every human being from the moment of conception is a person and entitled to the right to life.”

  • Description of Resolution: This Senate Joint Resolution is so-called "personhood" legislation that “every human being from the moment of conception is a person and entitled to the right to life.”
  • Does RESOLVE support or oppose this Resolution: RESOLVE opposes this Resolution.
  • Current status of the Resolution in the legislative process: SJR was introduced and referred to the Senate Committee on State Agencies and Governmental Affairs on 2/2/17.  It was amended, reintroduced and re-referred to Senate Committee on State Agencies and Governmental Affairs on 2/9/17. A hearing is scheduled for 2/14/17 and a vote is scheduled for 2/20/17. The bill failed but that vote was expunged and was voted on again and adopted on 2/28/17. The resolution was sent to the House on 2/28/17. On 3/1 the Resolution was read the first time, rules suspended, read the second time and referred to the Committee on State Agencies & Government Affairs- House. Hearing on this Resolution will be held on 3/8/2017. SJR 9 passed out of the house committee on 3/8/17. This resolution passed Senate and failed in the House. However they have expunged House vote and have re-referred the Resolution to the Committee on State Agencies & Governmental Affairs.

 State: Connecticut Bill Number: HB 5968  Bill Name: An Act Requiring Health Insurance Coverage For Fertility Preservation For Insureds Diagnosed With Cancer

 State: District of Columbia Bill Number: B21-0016   Bill Name: “Collaborative Reproduction Amendment Act of 2016”
Added: January 5, 2017

  • Description of Bill: This bill legalizes compensated gestational carrier arrangements in the District of Columbia and clarifies parentage for intended children from gestational surrogacy and from donor egg, sperm, and embryo. 
  • Does RESOLVE support or oppose this Bill: RESOLVE supports this Bill.
  • Current status of the Bill in the legislative process: The bill was introduced on January 6, 2015 and assigned to the Judiciary Committee. A Committee meeting is scheduled for November 30, 2016; if the bill passes out of Committee, the full City Council will have a first vote on December 6 and a second vote on December 20, 2016. The bill passed out of committee on November 30, 2016 and will be voted on by the full City Council on December 6, 2016. The bill was approved on first vote on December 6, 2016 and will be voted on for the second time on December 20, 2016. The Council voted in favor of the bill on December 20, 2016, and it now goes to the Mayor for her signature.

 State: Hawaii Bill Number: HB 664 and SB 502 Measure Title: Relating to In Vitro Fertilization Insurance Coverage

  • Description of Bill: This bill removes discriminatory requirements for mandatory insurance coverage of in vitro fertilization procedures to create parity of coverage for same-sex couples, unmarried women, and male-female couples for whom male infertility is the relevant factor.

  • Current status of the Bill in the legislative process: The House bill was introduced and read for the first time on January 23, 2017 and referred to the House Committee on Health, which recommended that the measure be deferred for the remainder of the session on 2/9/17. The Senate bill was introduced on 1/20/17 and passed with amendments from the Committee on Commerce, Consumer Protection and Health and the Committee on Judiciary and Labor on 02/03/17; the bill was referred to the Senate Ways and Means Committee with a public hearing on 2/23/17. On 3/15/17, the Committees on Health recommend that the measure be passed with amendments. Bill scheduled to be heard by Consumer Protection Committee on Thursday, 03-23-17 2:05PM in House conference room 329. The Consumer Protection Committee recommend that the measure be passed, unamended. Consumer Protection Committee Report adopted; referred to the House Committee on Finance.

State: Hawaii Bill Number: HB 677  Measure Title: Relating to In Vitro Fertilization Insurance Coverage

The Senate bill was referred to the Finance Committee on 2/3/17 with a hearing scheduled for 3/8/17.  Both Committees recommended an independent study on the financial impact of the bills to be completed in time for the bills to be considered next session.

 State: Minnesota Bill Numbers: SF 707 Bill Name: Gestational Carrier Act
Updated: February 14, 2017

  • Description of Bill: This bill establishes requirements for gestational carrier contracts and reflects the consensus points reached by the Legislative Commission on Surrogacy to protect all participants, including mental health/physical exams for gestational carrier candidates; mental health exams for intended parents; independent legal representation for gestational carriers and intended parents; and clarifying Minnesota’s parentage law so that intended parents don’t have to incur the expense of adopting their own child.

State: Missouri Bill Number: HB 112 Bill Name: Changes the laws regarding custody of in vitro human embryos

  • Description of Bill: This is a so-called "personhood" bill and establishes that the “in vitro human embryo is recognized as a human being in this state…and has all the rights, privileges, and immunities available to other persons.”

  • Current status of the Bill in the legislative process: This bill was introduced in the House and read for the second time on 01/05/2017. The bill was referred to the Judiciary Committee on 02/16/2017

 State: New Jersey Bill Number: A 1447 and S 1398 Bill Name: An Act concerning infertility coverage under certain health insurance plans.

  • Description of Bill: This bill expands the current infertility insurance mandate in New Jersey “to certain women that are currently denied coverage for those benefits under certain health insurance plans… such as lesbians, women without partners, or women with partners who have protected intercourse.”.

  • Current status of the Bill in the legislative process: The Assembly bill has been introduced and referred to Assembly Financial Institutions and Insurance Committee on 01/27/2016. The Senate bill was introduced and referred to State Commerce Committee on 2/11/2016. The Assembly bill was passed out of committee on 9/8/16 and now heads to the full chamber; the Senate bill was passed out of the Commerce Committee on 9/8/16 and heads to the Budget and Appropriations Committee. The Senate bill will be heard by the Budget Committee on 12/15/16 and the Assembly bill will be heard by the Appropriations Committee on 12/15/16. The Senate bill was reported from the Budget Committee on 12/15/16 and passed by the full Senate on 12/19/16. The Assembly bill was reported out of the Appropriations Committee on 12/15/16; a vote by the full Assembly has been scheduled for 1/23/17 with Amendments and recommitted to the Women and Children Committee, where it was reported out on 2/13/17, with a possible vote by the full Assembly on 2/15/17. The Assembly passed the bill on 2/15/17; it now goes to the Senate for a final vote to concur with amendments. Senate hearing is scheduled for 3/13/17. The Senate voted to pass the bill. The bill goes to the Governor's desk to be signed.

State: New York Bill Number: S 3148 and A 02646  Bill Name: The Fair Access to Fertility Treatment Act (FAFTA)

  • Description of Bill: This bill expands the current infertility insurance mandate in New York state to include insurance coverage of in vitro fertilization and fertility preservation for cancer patients and adds non-discrimination language to ensure that all eligible individuals can receive coverage.

 State: North Carolina Bill Number: H 163 Bill Name: Enact Right to Life at Conception Act
