2017 RESOLVE State Legislative Efforts

RESOLVE works with advocacy volunteers and other organizations to ensure equal access to all family building options for men and women experiencing infertility or other reproductive disorders. In 2017, RESOLVE will be tracking bills that impact the infertility community, whether they are pro-family or anti-family bills. Find out what is happening in your state.  State: Arkansas Resolution Number: SJR 9 Resolution Name: “An application to Congress to call a Convention for proposing an amendment under the United State Constitution, Article V, for the purpose of proposing an amendment providing that every human being from the moment of conception is a person and entitled to the right to life.”

  • Description of Resolution: This Senate Joint Resolution is so-called "personhood" legislation that “every human being from the moment of conception is a person and entitled to the right to life.”
  • Does RESOLVE support or oppose this Resolution: RESOLVE opposes this Resolution.
  • Current status of the Resolution in the legislative process: The resolution passed in Committee on 3/22/17 and was sent to the Senate, where it passed the full Senate on 3/30/17.  It was sent to the Governor for signature. To amend the U.S. Constitution, a constitutional convention must be called by two-thirds of the State legislatures so this resolution will have no impact and does not change any laws or practices in Arkansas.

State: Arkansas Bill Number: HB 2075 Bill Name: TO PROHIBIT COMMERCIAL SURROGACY ARRANGEMENTS AND THE ENFORCEMENT OF SURROGACY ARRANGEMENTS

  • Description of Bill: This bill will prohibit compensated surrogacy arrangements in the state.

 State: California Bill Number: AB 1396  Bill Name: Surrogacy

  • Description of Bill: Clarifies donor law, including egg donors, and venue/jurisdiction in CA, which is important when people leave CA and other states’ courts try to impose their law related to ART/donors/surrogacy.

State: California Bill Number: AB 569 Bill Name: the Reproductive Health Nondiscrimination Act

  • Description of Bill:  It would protect workers from firing or any other punishment for their reproductive health choices.

  • Current status of the Bill in the legislative process: The bill was introduced and was referred to Committees on Labor & Employment and Judiciary. A hearing is scheduled for 3/29/17. On 3/30/27, the committee voted do-pass and referred to the Committee on Judiciary. A hearing is scheduled for 4/25/2017.

State: California Bill Number: SB 172 Bill Name: Health care coverage: fertility preservation
Added: April 14, 2017

  • Description of Bill:  This bill impacts heath care plans issued on or before January 1, 2018 that covers hospital, medical, surgical, and other iatrogenic expenses for diagnoses with medical interventions that could or does lead to iatrogenic infertility. It requires those plans to also cover resulting infertility treatment. However, this will not impact specialized health care service plans or a specialized health insurance policies.

  • Current status of the Bill in the legislative process: SB. 172 was introduced on January 23rd, 2017. This legislation is being sponsored by Senator Anthony Portantino (D). On February 2nd, 2017 it was referred to the Committee on Health. It was released from Committee with the author’s amendments and re-referred to Committee on Health on March 7th, 2017.

State: California Bill Number: AB1396 Bill Name: An act to amend Sections 7610 and 7962 of the Family Code, relating to parentage.

  • Description of Bill: Eliminates the establishment of a parent-child relationship between a surrogate, as defined, and the child born to that surrogate.

 State: District of Columbia Bill Number: B21-0016   Bill Name: “Collaborative Reproduction Amendment Act of 2016”

  • Description of Bill: This bill legalizes compensated gestational carrier arrangements in the District of Columbia and clarifies parentage for intended children from gestational surrogacy and from donor egg, sperm, and embryo.

 State: Hawaii Bill Number: HB 664 and SB 502 Measure Title: Relating to In Vitro Fertilization Insurance Coverage

  • Description of Bill: This bill removes discriminatory requirements for mandatory insurance coverage of in vitro fertilization procedures to create parity of coverage for same-sex couples, unmarried women, and male-female couples for whom male infertility is the relevant factor.

State: Hawaii Bill Number: HB 677  Measure Title: Relating to In Vitro Fertilization Insurance Coverage

  • Description of Bill: This bill amends insurance coverage requirements for in vitro fertilization to allow for expanded applicability, including removing the five-year history of infertility requirement.

  • Current status of the Bill in the legislative process: The bill was introduced and read for the first time on January 23, 2017 and referred to the House Committee on Health, which recommended that the measure be deferred for the remainder of the session on 2/9/17. Bill scheduled to be heard by the House Committee on Health on 03-14-17.

State: Hawaii Bill Number: SB 515  Bill Name: Relating to In Vitro Fertilization Insurance Coverage
Added: April 14, 2017

  • Description of Bill: This legislation ensures an insured’s dependents are eligible to receive the one-time fertilization benefits outlined in her previous legislation (HB 664, HB 677, HB 1562, and SB 502) including coverage for expenses derived from in vitro fertilization procedures. These benefits include coverage for infertility related to endometriosis, exposure to in utero to diethylstilbestrol, blocked or removed fallopian tubes, abnormal male factors contributing to infertility.

  • Current status of the Bill in the legislative process: Sen. Maile Shimabukuro introduced this legislation on January 20th, 2017 and referred this legislation to CPH/JDL and WAM on January 23rd, 2017. The CPH and JDL deferred this legislation on February 3rd, 2017.

 State: Illinois Bill Number: HB 1649 Bill Name: Insurance CD-FERTILITY PRESERVATION

  • Description of Bill:  Amends the Illinois Insurance Code to provide that a policy of accident or health insurance shall provide coverage for medically necessary expenses for standard fertility preservation services when a necessary medical treatment may directly or indirectly cause iatrogenic infertility to an enrollee.

The Senate bill was referred to the Finance Committee on 2/3/17 with a hearing scheduled for 3/8/17.  Both Committees recommended an independent study on the financial impact of the bills to be completed in time for the bills to be considered next session.

State: Maryland Bill Number: SB 96 Bill Name: Health Insurance - Coverage for Fertility Awareness-Based Methods
Added: April 14, 2017

  • Description of Bill: This bill requires certain insurers, particularly nonprofits, to provide coverage for fertility-awareness programs and prohibits them from charging copayments or deductibles for these programs. The bill also provides definitions and lists a set of example fertility-based programs.

  • Current status of the Bill in the legislative process: The House bill was referred to the Health and Government Operations Committee on 2/6/17 with a hearing scheduled for 3/2/17. The Senate bill was referred to the Finance Committee on 2/3/17 with a hearing scheduled for 3/8/17.  Both Committees recommended an independent study on the financial impact of the bills to be completed in time for the bills to be considered next session. The bill has been set on the Formal Calendar S Bills for Perfection for March 27.

 State: Minnesota Bill Numbers: SF 707 and HF 2593  Bill Name: Gestational Carrier Act

  • Description of Bill: This bill establishes requirements for gestational carrier contracts and reflects the consensus points reached by the Legislative Commission on Surrogacy to protect all participants, including mental health/physical exams for gestational carrier candidates; mental health exams for intended parents; independent legal representation for gestational carriers and intended parents; and clarifying Minnesota’s parentage law so that intended parents don’t have to incur the expense of adopting their own child.

State: Minnesota Bill Number: HF 4 Bill Name: Omnibus Tax Bill

  • Description of Bill: Current Minnesota law allows a tax credit of $2,000 in cases of stillbirths. This credit is to be used for burial costs. Members of the tax conference committee have approved a tax bill, H.F. 4, that denies parents who lose their child to stillbirth in a gestational surrogacy arrangement from receiving the tax credit.

  • Current status of the Bill in the legislative process: Legislative leaders are working with the Governor to reach agreement on the budget bills before the May 22nd deadline. The language barring the tax credit for intended parents in a gestational surrogacy arrangement has now been removed.

  • Description of Bill: An act to require health insurance policies which provide pregnancy related benefits to provide coverage for medically necessary expenses of diagnosis and treatment of infertility. The bill also covers fertility preservation for cancer patients and others whose medical treatment may cause infertility.

  • Current status of the Bill in the legislative process: HB 451 has been introduced in the House and referred to the Insurance Committee on 01/09/17. HB 507 was introduced and referred to the Insurance Committee on 01/13/17. SB 2655 was introduced in the Senate and referred to The Appropriations and Insurance Committees on 01/16/17. Bills died in committee on 1/31/17.
