2016 RESOLVE State Legislative Efforts

RESOLVE works with advocacy volunteers and other organizations to ensure equal access to all family building options for men and women experiencing infertility or other reproductive disorders. In 2016, RESOLVE will be tracking bills that impact the infertility community, whether they are pro-family or anti-family bills. Find out what is happening in your state. If you know of a bill in your state but it is not listed below, please contact RESOLVE at info@resolve.org. Some states are evaluating Personhood bills or ballot initiatives.  State: Alabama Bill Number: [R] HB 300  Bill Name: Personhood Constitutional Amendment

  • Description of Bill: HB 300 is a "personhood" bill that would define the term “persons”  to include all humans from the moment of fertilization.”  
  • Does RESOLVE support or oppose this Bill: RESOLVE opposes this Bill.
  • Current status of the Bill in the legislative process: On 2/24/16, the bill was read for the first time and referred to the House Health Committee, which favorably reported it to the House on 4/13/16.

 State: California Bill Number: AB 2531

  • Description of Bill: The bill seeks to create equity in the field of medical research compensation by removing the prohibition on compensation for women participating in oocyte (egg) donation for medical research.
  • Does RESOLVE support or oppose this Bill: RESOLVE supports this Bill.
  • Current status of the Bill in the legislative process: This bill was referred to the Assembly Health Committee on 03/08/16 and a hearing was scheduled for 4/5/16. The bill passed the Assembly Health Committee on 4/5/16 and passed in the full Assembly on 4/28/16 and ordered to the Senate, where it was referred to the Committees on Health and Appropriations on 5/5/16. The bill passed the Senate Health Committee on 6/15/16.

 State: Colorado Bill Number: HB 1007  Bill Name: "An Act Concerning Offenses Against Unborn Children.”
Added: February 16, 2016

  • Description of Bill: HB 1007 is a so-called "personhood" bill and provides that homicide charges can be brought for the death of an "unborn member of the species homo sapiens.”

  • Current status of the Bill in the legislative process: This bill was introduced in the House and assigned to Business Affairs and Labor on 01/13/2016, where it was postponed indefinitely on 02/11/2016.

State: Colorado Bill Number: HB 1113 Bill Name: "A bill for an act relating to the protection of life beginning at conception”  
Added: February 14, 2016

  • Description of Bill: HB 1113 is a so-called "personhood" bill and establishes that an embryo is “an individual living member of the species homo sapiens, throughout the entire embryonic and fetal ages of the unborn child from fertilization to full gestation and childbirth.”

  • Current status of the Bill in the legislative process: This bill was introduced in the House and assigned to Health, Insurance, & Environment Committee on 1/20/2016. The Committee voted to postpone the bill indefinitely on 02/11/2016.

 State: Connecticut Bill Number: HB 5230  Bill Name: An Act Requiring Health Insurance Coverage For Fertility Preservation For Insureds Diagnosed With Cancer

  • Description of Bill: This bill would mandate insurance coverage for fertility preservation for men and women before undergoing cancer treatments.

  • Current status of the Bill in the legislative process: The bill was referred to the House Joint Committee on Insurance and Real Estate on 02/16/16 with a public hearing scheduled for 03/01/16. The Committee approved the bill with a religious exemption added on 03/10/16.

 State: District of Columbia Bill Number: B21-0016   Bill Name: “Collaborative Reproduction Amendment Act of 2016”

  • Description of Bill: This bill legalizes compensated gestational carrier arrangements in the District of Columbia and clarifies parentage for intended children from gestational surrogacy and from donor egg, sperm, and embryo. 
  • Does RESOLVE support or oppose this Bill: RESOLVE supports this Bill.
  • Current status of the Bill in the legislative process: The bill was introduced on January 6, 2015 and assigned to the Judiciary Committee. A Committee meeting is scheduled for November 30, 2016; if the bill passes out of Committee, the full City Council will have a first vote on December 6 and a second vote on December 20, 2016. The bill passed out of committee on November 30, 2016 and will be voted on by the full City Council on December 6, 2016. The bill was approved on first vote on December 6, 2016 and will be voted on for the second time on December 20, 2016. The Council voted in favor of the bill on December 20, 2016, and it now goes to the Mayor for her signature.

 State: Florida Bill Number: SB 1718 and HB 865 Bill Name: “Florida for Life Act”

  • Description of Bill: This bill is a so-called "personhood" bill and establishes that "Human life means a human person and is the biological development of the species homo sapiens that begins when a human egg is fertilized by a human sperm and continues to develop as a living organism.”
  • Does RESOLVE support or oppose this Bill: RESOLVE opposes this Bill.
  • Current status of the Bill in the legislative process: SB 1718 was introduced and referred to the Senate Health Policy Committee on 1/20/2016;HB 865 was referred to the House Justice Appropriations Subcommittee on 1/25/16.

 State: Georgia House Resolution Number: HR 1091 Added: January 26, 2016

  • Description of Resolution: This is not a bill per se, but a House Resolution, which is typically used to recognize important people or convey the sense of the Georgia Assembly. This resolution proposes an amendment to the State Constitution to “recognize the paramount right to life of all human beings as persons at any stage of development.” If passed, this would send a message that the Georgia Assembly has stated their opinion that microscopic embryos are people with rights.

 State: Georgia Bill Number: HB 287 Bill Name: "Ethical Treatment of Embryo Act”  Added: January 26, 2016

  • Description of Bill: HB 287 is a so-called "personhood" bill that would confer judicial rights to in vitro human embryos.

  • Current status of the Bill in the legislative process: On 1/22/16, the bill was removed from its scheduled hearing.

State: Hawaii Bill Numbers: HB 672 and SB 789  Measure Title: Relating to In Vitro Fertilization Insurance Coverage

  • Description of Bill: This bill completely updates the current Hawaii IVF insurance mandate and allows for only 1 year waiting period, more IVF cycles, and removes discriminatory language.

 State: Iowa Bill Number: HF 2142 Bill Name: "A bill for an act relating to the protection of life beginning at conception”

  • Description of Bill: HF 2142 is a so-called "personhood" bill and establishes that “life is … protected from the moment of conception and each life is accorded the same rights and protections guaranteed to all persons.”

 State: Maryland Bill Number: SB 1 and HB 11

  • Description of Bill: This bill changes the current IVF mandate and eliminates the requirement for heterosexual married couples to use “husband’s sperm” for in vitro fertilization. 
  • Does RESOLVE support or oppose this Bill: RESOLVE supports this bill.
  • Current status of the Bill in the legislative process: The bill was introduced and referred to the Senate Finance Committee and House Health and Government Operations Committee for reading on January 13, 2016. SB 1 bill hearing to be held on January 20, 2016. HB 11 bill hearing to be held on January 28, 2016. SB 1 with minor Amendments was passed in the Senate on February 1, 2016. HB 11 was passed in the House with minor Amendments on February 16, 2016. The amended Senate bill had a first reading in House Health and Government Operations on February 2, 2016. The amended House bill had a first reading in Senate Finance on February 22, 2016. The bill passed in both chambers on 3/30-31/2016 and will be presented to the Governor. The bill wassigned into law by the Governor on 5/10/16.

  • Description of Resolution: Recognizes and finds “that the life of the human person commences at conception and that specified decisions of the U.S. Supreme Court are based on false science.”

State: Maryland Bill Number: HB 968 Bill Name: “Orders of Parentage”

  • Description of Bill: This bill would codify into law the best practices in gestational carrier surrogacy in Maryland.
